Senate Order on departmental contracts

Period 1 July 2009 to 30 June 2010

Pursuant to the amended Senate Order on departmental contracts the following table sets out the contracts entered into by the Department of Broadband, Communications and the Digital Economy, which provide for a consideration to the value of $100 000 or more. As of 30 June 2010 these contracts have not been fully performed nor have they been entered into during the 12 months prior to 30 June 2010.

Most of the contracts listed contain confidentiality provisions of a general nature that are designed to protect the confidential information of the parties that may be obtained or generated in carrying out the contract. This is a standard confidentiality clause.

The list includes the contract title, contractor, the amount of consideration, the commencement date, anticipated end date and the subject matter of each contract plus:

  • whether contract contains provisions requiring the parties to maintain confidentiality of any of its provisions
  • whether contract contains other requirements of confidentiality.

The reasons for including such clauses for both items (a) and (b) above, include:

  1. internal costing/profit information
  2. artistic, literary or cultural secrets
  3. the Privacy Act 1988
  4. public interest
  5. statutory secrecy provision(s)
  6. intellectual property
  7. other

Cost of compliance

The estimated cost to the Department of complying with the order is $1305.36 and was calculated using the following multiples:

  • the number of staff used on this request
  • the nominal salary level of staff
  • the hours worked on the task.
