Senate Order of Continuing Effect (Order for the Production of Documents No. 11 Departmental and Agency Contracts)

On 20 June 2001, as amended on 1 March 2007, the Senate agreed to a motion by Senator Murray requiring all Australian Government departments and agencies to produce a list of all contracts (procurement and grants) which meet the following criteria:

  • are valued at $100 000 (GST inclusive) or more, and
  • were entered into in the previous 12 months, or
  • were not fully completed at the end of the period.

The lists are tabled two times a year, no later than two calendar months after the last day of the financial and calendar year.

Most of the contracts listed contain confidentiality provisions of a general nature that protect the confidential information that parties may obtain or generate in carrying out the contract. This is a standard confidentiality clause.

The list includes the contract title, contractor, the amount of consideration, the commencement date, anticipated end date and the subject matter of each contract, plus whether the contract contains provisions requiring the parties to maintain confidentiality of any of its provisions or whether the contract contains other requirements of confidentiality.
