Radiocommunications competition

The Radiocommunications Act 1992 enables application of sections of the Trade Practices Act 1974 to allocating and issuing radiocommunications licences. This allows the anti-competitive acquisition rules in the Trade Practices Act to be applied to the allocation and issue of licences for spectrum.

The Minister also has the power to set competition limits on spectrum or licences issued as part of a particular price-based allocation of radiocommunications licences.

In considering the imposition of competition limits, the Government considers, among other things, promoting long-term sustainable competition in telecommunications, (including facilitating efficient market entry) the entry of new players, enabling firms to acquire spectrum to introduce new technologies and receiving an appropriate return for the Australian Government.
