Public consultation on re-issue of expiring 15 year spectrum licenses

The Department of Broadband, Communications and the Digital Economy is seeking public comment on a draft ministerial determination and direction regarding the possible re-issue of expiring 15 year spectrum licences.

In the late 1990s, the Government auctioned spectrum licences which are now used to deliver 2G and 3G mobile services. These licences are due to expire from 2013.

In March 2010, Minister for Broadband, Communications and the Digital Economy, Senator Stephen Conroy announced a process to consider whether key expiring spectrum licences should be re-issued.

Senator Conroy has the power under the Radiocommunications Act 1992 to specify classes of services for which it would be in the public interest to re-issue licences to the same licensees (section 82(3)) and to direct the Australian Communications and Media Authority regarding the value of the spectrum (section 294(2)).

To inform Senator Conroy’s decision, the department has undertaken an information gathering consultation with key licence holders Telstra, Optus, Vodafone Hutchison Australia and vividwireless.
