Key elements of the legislation


3.1.1 Are there ways that the opt out structure of the scheme could be improved?

Yes, I believe that an OPT IN method is a better idea.  It is very inconvenient when receiving many faxes, emails and phone calls, every week, for both companies that I work for to actually have an opt out method.

3.2.1 Are there ways that express consent could be improved?

Yes.  If I give express consent to an organisation, I expect that this information will not be on sold to other organisations.

3.2.2 Are there ways that inferred consent could be improved?

Yes.  When the relationship ends with the supplier, that will then end the inferred consent.  Again providing that my information is not on sold to others.

3.3.1 Are there ways that the registration period could be improved?

3.4.1 Are the current exemptions appropriate and relevant?

3.5.1 Should 'research calls' be defined in the Act to clearly distinguish between calls with a commercial purpose and calls with a research purpose?

Although this could be very valuable information, I object to time wasting in business hours, while trying to conduct my business.

Operation of the Register


4.2.1 Is the registration process effective and easy to use?

Yes for private numbers but businesses do not have this option.  Please allow for businesses to be registered.

4.2.2 Is the washing process effective and easy to use?

Yes

4.2.3 Are there ways to improve either of these processes?

No

4.3.1 Are there ways that the complaints handling process could be improved?

I have not had an issue to complain about so cannot comment.

4.3.2 Are the penalties in the Act appropriate and a sufficient deterrent?

Yes

4.4.1 Do you have any comments on the education and awareness activities undertaken by the ACMA?

No

4.4.2 Is information on the Register easy to find and understand?

Yes

4.5.1 Should industry codes and standards apply to organisations outside of the telemarketing industry that are causing telemarketing calls to be made?

Yes, I believe it should happen across the board.

4.5.2 Should the process for making industry codes and standards be faster, more flexible and more responsive to community needs?

No it is acceptable

4.5.3 Should the Register scheme include additional rules requiring telemarketers to:

Keep records of their calls?

Yes, definitely

Keep internal do not call lists?

Yes, definitely

Limit the number and frequency of silent calls?

None should be made due to the feeling of being threatened.

5.1.1 Do you have any other comments or concerns about the Register?

Yes.  I would like businesses of all sizes to be included on the Do Not Call Register.  The amount of phone calls that I receive weekly is inconvenient and obtrusive.  It is time wasting to have to go online and deregister, or send a return fax to deregister our companies.
